These Terms of Use govern your use of KiraSpark: Sparkle Camera (“KiraSpark”, “the app”), provided by NEURAL CRAFT LIMITED (“we”, “us”, or “our”). By downloading, installing, or using KiraSpark, you agree to these Terms.
These Terms are product-specific. They supplement the general OhMyApps Terms of Service and any terms that apply through Apple, including Apple’s Licensed Application End User License Agreement. If you do not agree to these Terms, do not use the app.
What KiraSpark Does
KiraSpark is an iOS camera and photo editing app for adding sparkle effects to photos. The current app lets you:
- preview sparkle effects in the live camera view;
- capture a photo with the rendered sparkle effect;
- import an existing photo from your library;
- adjust sparkle intensity and filters;
- save the rendered JPEG to Photos; and
- share the rendered JPEG through the iOS share sheet.
KiraSpark is an aesthetic photo effects tool. It is not a professional photography, measurement, security, identity, medical, legal, or safety tool.
License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use KiraSpark for your personal use on devices you own or control, as permitted by the App Store rules and applicable platform terms.
You may not copy, redistribute, sell, sublicense, modify, reverse engineer, or attempt to derive the source code of the app except where applicable law or open-source license terms expressly allow it.
Your Photos and Content
You keep your rights to photos and other content you capture, import, save, or share through KiraSpark.
You are responsible for making sure you have the rights and permissions needed for any photo or content you use with the app. Do not use KiraSpark in a way that violates another person’s privacy, intellectual property rights, publicity rights, or applicable law.
When you use the app to process a photo, you allow the app to process that photo on your device for the purpose of producing the rendered result you requested.
Permissions and Sharing
KiraSpark may ask for camera access and add-only Photos access so the app can provide its core features. You can manage these permissions in iOS Settings.
If you share an image through the iOS share sheet, the destination you choose is responsible for its own service, terms, and privacy practices. We are not responsible for third-party services you choose to use.
Purchases, Ads, and Accounts
The current KiraSpark app does not include an account system, ads, subscriptions, or in-app purchases.
If App Store download, purchase, refund, tax, or payment rules apply to your copy of the app, those matters are handled by Apple under Apple’s applicable terms.
Acceptable Use
You agree not to:
- use the app for unlawful, harmful, abusive, or infringing purposes;
- interfere with the app, Apple platform services, or other users’ devices or services;
- use the app to create or distribute content that violates applicable law or another person’s rights;
- misrepresent edited photos in a way that causes harm or violates law; or
- bypass, disable, or interfere with security, licensing, or platform restrictions.
Availability and Changes
We may update, change, suspend, or discontinue KiraSpark or any feature at any time. Some features depend on iOS, device capabilities, App Store availability, permissions, or third-party services and may not work in every environment.
No Warranty
KiraSpark is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted or error-free operation.
Nothing in these Terms limits any rights you may have under consumer protection laws that cannot be excluded by contract.
Limitation of Liability
To the maximum extent permitted by law, NEURAL CRAFT LIMITED will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity arising from or related to your use of KiraSpark.
Our total liability for claims related to KiraSpark will be limited to the amount you paid for the app, if any, except where applicable law requires otherwise.
Termination
You may stop using KiraSpark at any time by deleting the app from your device. We may terminate or suspend your license to use the app if you violate these Terms.
Governing Law
These Terms are governed by the laws of the jurisdiction where NEURAL CRAFT LIMITED is established, except where mandatory local law gives you additional rights.
Changes to These Terms
We may update these Terms as KiraSpark changes or as legal, platform, or operational requirements change. The updated Terms will show a new “Last updated” date.
